General Terms of Purchase at Tesoros Naturales

1. What is this document?

This text constitutes the CONTRACT that will govern the relationship between TESOROSNATURALES.COM (Mesas Sanchez, Nicolás, with DNI 19.093.935-W and registered address in Cadrete - Zaragoza) and You (the USER), when purchasing products through our online store TESOROSNATURALES.COM. This text describes the conditions that regulate the purchase of products through our online store, the rights and obligations of the parties, and information on how to buy, all in compliance with Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSI).

2. Acceptance and Duration of the General Terms.

These General Terms are mandatory for both parties. The CLIENT will be bound by all of these General Terms without reservation when purchasing our products on the TESOROSNATURALES.COM website, and it is their obligation and responsibility to read them beforehand.

During the ordering process, before authorizing payment, the CLIENT must accept the General Terms. If you do not agree with them, do not proceed with the purchase process, as these terms will apply to you in all cases.

3. Products.

TESOROS NATURALES is a company specialized in the collection of high-quality fossils and minerals from around the world since 1980. The products we sell include fossils, minerals, and handcrafted items made with special stones or materials.

4. Prices.

All prices listed on TESOROSNATURALES.COM include VAT, and the price will be the one specified on the website at all times.

TESOROSNATURALES.COM reserves the right to modify the prices and sales conditions of the products. However, the price and conditions in place at the time the CLIENT places the order will always be respected and applied.

5. Shipping Costs.

TESOROS NATURALES ships through Seur and the Spanish transport company Correos y Telégrafos.

Shipping costs depend on the weight of the product and the destination country. When placing your order, the shipping costs will be automatically calculated once you fill in your Identification Details, but they will not be registered until you complete the purchase.

Shipping is free for purchases over 85 euros when purchasing as a registered user. If you wish to purchase as a guest, shipping is free for orders over 200 euros.

6. Purchase Process.

The CLIENT must be at least 18 years old. The steps are as follows:

1. Once the desired product(s) are selected, the "Shopping Cart" will display all selected products in a list, showing the product name, final price including taxes and applicable discounts. You can proceed with the purchase by Creating a User Account or Buying as a Guest.
2. In both cases, you will be required to fill out a form with your personal details to purchase the product and complete the purchase. When filling in the identification details, specifically the Postal Code in Spain or the Country elsewhere, the shipping costs will automatically appear, except in cases where shipping is free, which will also be displayed in a message. You can choose the payment method and enter a different shipping address from the billing address if desired.
3. In both cases, selecting the "Confirm Purchase" button formalizes the contract process, but only after checking the box to accept the terms and privacy policy. Once the order is placed, it is subject to our acceptance. Within 48 hours, we will send a confirmation email. TESOROS NATURALES is not responsible for errors or failures in the email address provided by the CLIENT.

7. Payment Methods.

TESOROS NATURALES offers three payment options, ensuring security and confidentiality:

• Credit Card with no additional charges:

You can pay with a credit or debit card through our secure payment gateway and SSL server at no additional cost, with all security protocols in place. Once the purchase process is completed, you will receive a confirmation email.

• PayPal payment with no additional charges:

PayPal is an Internet service company that acts as a secure, fast, and easy payment intermediary. When making the payment and completing the purchase process, PayPal charges your credit card the exact amount, without additional costs. You only need to fill out a quick electronic payment form. Once completed for the first time, you are registered as a PayPal user and have an account reflecting all transactions made. Both you and our company, TESOROS NATURALES, will receive an email confirming the transaction, and we will proceed to ship the purchased items.

• Bizum Payment (Only valid in Spain):

You can pay for your online purchases quickly, conveniently, and securely. Simply select the "Pay with Bizum" option, enter your phone number, and validate the transaction.

8. Product Delivery.

Depending on the payment method, the wait time for the purchased product may range from 2 to 10 days, although delivery will always be completed within a maximum period of 30 days from the contract date.

9. Product Availability.

The majority of our products are unique pieces, and only some are subject to availability from our suppliers. If an item is out of stock, we will inform you as soon as possible and offer an alternative or cancel the order at the customer's choice. The amount will be refunded within a maximum of 14 days. The refund of these amounts will be the limit of our liability to the customer if we are unable to provide the requested product.

10. Right of Withdrawal.

TESOROS NATURALES will act according to the reason for the return as follows: If the item does not meet your expectations, you may exercise your right of withdrawal within 14 calendar days for a return, in compliance with Directive 2011/83/EU on consumer rights, counting from the day after the receipt date. You must notify us via email, and once the item is received at our company, the purchase amount will be refunded, excluding shipping costs as indicated by the aforementioned Directive. If the item is damaged, you must notify us immediately upon receipt so that TESOROS NATURALES can file a claim with the transport company. The transport company will collect the item, send it to us, and we will refund your money upon receipt. This scenario is very rare, as we carefully protect all our shipments. 11. Product Warranty.

A two-year warranty will apply to products that present any kind of defect or flaw. Non-conformities resulting from improper use of the product or ordinary wear and tear caused by its use will not be considered as defects.

If a product is defective, TESOROSNATURALES will proceed with its repair, replacement, price reduction, or contract termination. All these measures will be at the buyer’s choice and free of charge, with TESOROSNATURALES.COM covering the shipping costs of the product.

The claim must be submitted within two months of detecting the non-conformity of the product, describing the issue in an email to INFO@TESOROSNATURALES.COM, and we will contact you to resolve your claim.

13. Responsibilities.

TESOROS NATURALES shall not be liable, under any circumstances, for damages of any kind that may be caused, including but not limited to, the following actions: possible internet server failures preventing access to one or more pages of the Portal, errors or omissions in the Content, or the transmission of viruses or harmful or malicious codes in the Content, despite having taken all technical measures to prevent it.

14. Intellectual and Industrial Property.

TESOROS NATURALES, either as the owner or assignee, holds all intellectual and industrial property rights of the Portal and the elements contained therein (including but not limited to images, sound, audio, video, software, texts, trademarks or logos, color combinations, structure and design, selection of materials used, computer programs necessary for its operation, access, and use, etc.), owned by TESOROS NATURALES or its licensors. All rights reserved. Pursuant to Articles 8 and 32.1, second paragraph, of the Intellectual Property Law, the reproduction, distribution, and public communication, including the mode of making available, of all or part of the Content of this website, for commercial purposes, on any medium and by any technical means, without the authorization of TESOROS NATURALES, is expressly prohibited. The User agrees to respect the Intellectual and Industrial Property rights owned by TESOROS NATURALES. The User must refrain from deleting, altering, bypassing, or manipulating any protection device or security system installed on TESOROS NATURALES’ web pages.

15. Contract Integrity.

If any clause of this contract is deemed void or null, it shall be considered as not included, while the rest of the contract will remain fully binding between the parties.

16. Applicable Law and Jurisdiction.

In the event of any conflict, dispute, or legal controversy that may arise, TESOROS NATURALES and the User shall be governed by Spanish law, as well as these Terms and Conditions, and shall submit, if applicable, to the Courts and Tribunals of the city of Zaragoza, Spain.
